2. Rose AI Assistant Services
Service Description
Rose is an AI-powered business management assistant designed for contractors throughout the United States. Rose provides automated assistance with business operations including lead management, expense tracking, job costing, scheduling, and business intelligence through SMS communication and a web-based dashboard.
Subscription Tiers
Rose is offered as a subscription service with the following tiers:
- Starter – $149/month
- Pro – $299/month
- Business – $499/month
Specific features available at each tier are described on our website and may change over time.
AI-Generated Content
Rose uses artificial intelligence (including third-party AI services) to generate responses, analyze data, and provide recommendations. You understand and agree that:
- AI-generated content may contain errors, inaccuracies, or omissions
- AI responses are not professional advice (legal, financial, accounting, or otherwise)
- You are responsible for verifying AI-generated information before acting on it
- AI capabilities and responses may vary and are not guaranteed
- We may update, modify, or change AI functionality at any time
Data Processing
When you use Rose, we process your business data including:

- Receipt images and expense data
- Job and project information
- Financial and profitability data

Account Responsibilities
As a Rose subscriber, you are responsible for:
- Maintaining accurate account and business information
- Securing your account credentials and authorized devices
- Ensuring your use complies with applicable laws and regulations
- Obtaining necessary consents from your customers for data processing
- Backing up your own business records (Rose is not a backup service)
3. SMS Communication Agreement
Consent to Receive SMS Messages
By signing up for Rose or providing your phone number to our Services, you consent to receive text messages (SMS and MMS) from Kore Komfort Solutions and Rose at the mobile phone number you provide. These messages include:
For Rose Subscribers (Contractors):
- Responses to your questions and commands
- Lead notifications and customer inquiries forwarded to you
- Appointment reminders and schedule updates
- Morning briefings and business alerts
- Receipt confirmations and job cost updates
- Service notifications and account alerts
For Homeowners Using Our Services:
- Contractor connection confirmations
- Service-related notifications
- Marketing messages (if you opt in)
Phone Numbers Used
Messages may be sent from:
- Toll-free numbers (e.g., 888, 877, 866, 855, 844, 833 area codes)
- Local phone numbers associated with your Rose account or our Services
- Short codes for specific notifications
Message Frequency
The number of messages you receive depends on your use of our Services:
- Rose subscribers: Message frequency varies based on your usage, lead volume, and settings. Active users typically receive 10-50+ messages per week.
- Homeowners: Occasional messages related to contractor connections and services.
Costs
Kore Komfort Solutions does not charge for SMS messages sent through our Services (SMS is included in Rose subscription pricing). However, standard message and data rates from your mobile carrier may apply. Contact your carrier for details about your messaging plan.
Opting Out
You can stop receiving SMS messages at any time:
- Text STOP to any number from which you receive messages
- Contact us at mike@korekomfortsolutions.com
- Adjust notification settings in your Rose dashboard (for subscribers)
Important: If you opt out of SMS as a Rose subscriber, this will significantly impact or disable your Rose service, as SMS is the primary communication method.

Your Representations
By providing your phone number and using our SMS-enabled Services, you confirm that:
- You are the owner or authorized user of the mobile phone number provided
- You consent to receive SMS/MMS messages from Kore Komfort Solutions and Rose
- You understand that message and data rates from your carrier may apply
- You can opt out at any time by replying STOP
- You will notify us immediately if you change your phone number
Customer Communications (For Rose Subscribers)
If you use Rose to communicate with your customers, you are responsible for:
- Obtaining proper consent from your customers to receive SMS messages
- Complying with all applicable laws regarding SMS marketing and communications (including TCPA, CAN-SPAM, and state laws)
- Honoring opt-out requests from your customers
- Ensuring message content complies with carrier policies and applicable law
We provide tools to help you manage consent and opt-outs, but compliance is ultimately your responsibility.
4. Eligibility and Registration
Age Requirement
You must be at least 18 years old to use our Services. If you are under 18, you may only use our Services with the involvement and consent of a parent or legal guardian.
Our Services are not intended for children under 16. We do not knowingly collect information from children under 16. See our Privacy Policy for details.
Account Registration
For Rose: Registration and account creation is required. When creating an account:
- You must provide accurate, current, and complete information
- You are responsible for maintaining the security of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
For Educational Content: Currently, we do not require user account registration to access our educational website content. If we introduce account features in the future, the above requirements will apply.

- Educational content and contractor connections: Primarily intended for users in Ohio, Kentucky, Indiana, and Tennessee. While anyone may access our educational content, our contractor connection services are limited to these states.
- Rose AI Assistant: Available to contractors throughout the United States.
5. Acceptable Use Policy
Permitted Uses
You may use our Services to:
- Read and learn from our educational content
- Request connections with contractors for legitimate home improvement projects
- Subscribe to our newsletter
- Leave constructive comments on our articles
- Share our content on social media (with proper attribution)
- Click affiliate links to purchase products you find helpful
- Subscribe to and use Rose for legitimate business management purposes
- Communicate with Rose via SMS for authorized business functions
Prohibited Uses
You may NOT use our Services to:

- Violate any applicable local, state, federal, or international law
- Infringe on intellectual property rights of Kore Komfort or others
- Harass, abuse, threaten, or harm others
- Impersonate any person or entity, or misrepresent your affiliation
- Collect or store personal data about other users without permission
- Send spam, unsolicited messages, or prohibited content through Rose
- Use Rose to harass, threaten, or send inappropriate messages to anyone
Technical Abuse
- Attempt to gain unauthorized access to our servers, systems, or networks
- Use automated systems (bots, scrapers, crawlers) without permission
- Introduce viruses, malware, or other harmful code
- Interfere with or disrupt the Services or servers
- Reverse engineer, decompile, or disassemble any part of the Services
- Attempt to bypass rate limits, usage restrictions, or security measures
- Access or attempt to access other users’ accounts or data
Commercial Abuse
- Copy, reproduce, or republish our content for commercial purposes without written permission
- Use our Services to compete with us or build a similar service
- Submit fake contractor requests to spam our network
- Manipulate affiliate links for fraudulent purposes
- Use our content to train AI models or build derivative databases without permission
- Resell, sublicense, or redistribute Rose services without authorization
- Use Rose for any illegal business activity
Content Abuse
- Post spam, advertisements, or unsolicited promotional content in comments
- Post content that is obscene, defamatory, or contains hate speech
- Post content that violates privacy or publicity rights
- Post false or misleading information
- Send prohibited content through Rose SMS (illegal content, spam, phishing, etc.)
Enforcement
We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including:
- Removing violating content
- Suspending or terminating access to Services
- Suspending or terminating Rose subscriptions (without refund for cause)
- Reporting violations to law enforcement
- Pursuing legal action
6. Intellectual Property Rights
Our Content and Ownership
All content on our Services—including text, articles, graphics, logos, images, videos, software, AI models, algorithms, and other materials (collectively, “Content”)—is owned by Kore Komfort Solutions LLC or our content suppliers and is protected by copyright, trademark, and other intellectual property laws.

Your Responsibilities

- You own or have the right to use the content you submit
- Your content does not infringe intellectual property rights of others

8. Contractor Connections and Referrals
How Contractor Connections Work
When you submit a contractor connection request:
- You provide project details and contact information
- We match you with 1-5 contractors in our network based on location, expertise, and availability
- We share your information with those contractors
- Contractors contact you directly to provide quotes or consultations
- You choose whether to hire any contractor (no obligation)
Independent Contractors
CRITICAL UNDERSTANDING: Contractors in our network are independent businesses, NOT employees or agents of Kore Komfort Solutions. We:
- Do NOT employ contractors
- Do NOT control how contractors perform their work
- Do NOT set contractors’ prices or terms
- Do NOT guarantee contractors’ work quality, timing, or pricing
- Do NOT supervise or inspect contractors’ work
Contractor Vetting
We vet contractors in our network based on:
- Valid licenses and insurance (where required)
- Customer reviews and reputation
- Experience in the Ohio Valley region
- Professional communication and conduct
However, our vetting does NOT constitute a guarantee or warranty of contractor performance. You are responsible for:
- Verifying contractors’ licenses, insurance, and credentials independently
- Obtaining multiple quotes and checking references
- Negotiating terms, pricing, and contracts directly with contractors
- Ensuring contractors pull necessary permits
- Inspecting completed work
Your Relationship with Contractors
Any agreement you make with a contractor is directly between you and that contractor. Kore Komfort Solutions is not a party to that agreement and has no liability for:
- Work quality, defects, or damage caused by contractors
- Contractors’ failure to complete work or meet deadlines
- Pricing disputes or payment issues
- Contractors’ negligence, misconduct, or illegal activity
- Personal injury or property damage related to contractor work
- Violations of building codes or permit requirements
Contractor Compensation Disclosure
We earn revenue when we connect you with contractors (see our Affiliate Disclosure Policy). This compensation does NOT:
- Increase your project costs (contractors pay us, not you)
- Influence which contractors we recommend (we prioritize homeowner satisfaction)
- Create any liability for contractor performance
- Make us responsible for contractor work
Dispute Resolution with Contractors
If you have a dispute with a contractor:
- Communicate your concerns to the contractor directly
- Document all communications and issues
- Consult your written contract with the contractor
- Consider mediation or arbitration if specified in your contract
- Contact your state’s contractor licensing board if necessary
While we want to hear about your experience (good or bad), we cannot mediate disputes between homeowners and contractors, nor can we force contractors to resolve issues.

- A professional services agreement

- An agency or employment relationship
- An accountant-client or attorney-client relationship

- Endorse third-party content or websites
- Verify accuracy of third-party information

Even if we have been advised of the possibility of such damages.
Maximum Liability Cap
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE GREATER OF:
(a) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR
(b) ONE HUNDRED DOLLARS ($100)
Basis of the Bargain

You agree to indemnify, defend, and hold harmless Kore Komfort Solutions LLC, its officers, directors, employees, contractors, agents, and affiliates from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:
- Your use or misuse of our Services
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of any third-party rights (intellectual property, privacy, etc.)
- Content you submit to our Services
- Your relationship with any contractor you hire through our Services
- Home improvement work performed on your property (whether by contractors we referred or not)
- Your purchase or use of products through our affiliate links
- Your use of Rose to communicate with your customers or third parties
- Your failure to comply with SMS/communications laws when using Rose
- Claims by your customers, employees, or third parties related to your use of Rose
- Business decisions you make based on Rose data or recommendations
This indemnification obligation will survive termination of these Terms and your use of our Services.
13. Dispute Resolution and Governing Law
Governing Law
These Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of courts located in Wyoming for any legal disputes.
Informal Resolution First
Before filing any legal claim, you agree to contact us at mike@korekomfortsolutions.com to attempt to resolve the dispute informally. We will work in good faith to resolve disputes within 30 days.
Arbitration Agreement
If informal resolution fails, you agree that any dispute, claim, or controversy arising from or relating to these Terms or our Services shall be resolved by binding arbitration, except:
- Either party may seek injunctive relief in court for intellectual property infringement
- Either party may bring claims in small claims court if they qualify
Arbitration Rules
- Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules
- Arbitration will be held in Wyoming unless both parties agree otherwise
- The arbitrator’s decision will be final and binding
- Each party bears their own costs and attorneys’ fees unless otherwise awarded by the arbitrator
Class Action Waiver
YOU AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.
If this class action waiver is found unenforceable, the entire arbitration agreement shall be void.
Statute of Limitations
You must bring any claim against us within one (1) year of the cause of action arising, or the claim is permanently barred.

15. Termination
Our Right to Terminate
We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, with or without notice, including if:
- You violate these Terms
- You engage in fraudulent, illegal, or harmful activity
- You fail to pay subscription fees (for Rose)
- We discontinue providing Services
- Required by law or government authority
Your Right to Terminate
General Services: You may stop using our Services at any time. To cancel email subscriptions, use the unsubscribe link in any email or contact us at mike@korekomfortsolutions.com.
Rose Subscriptions: You may cancel your Rose subscription at any time through your account dashboard or by contacting us. Cancellation will be effective at the end of your current billing period. No refunds are provided for partial months.
Effect of Termination
Upon termination:
- Your right to use our Services immediately ceases
- Your Rose account and access will be disabled
- We may delete your data after a reasonable retention period (see Privacy Policy)
- Sections of these Terms that by their nature should survive termination will survive (including disclaimers, limitations of liability, indemnification, dispute resolution)
